Delhi High Court Declines Plea for Special Assembly Session on CAG Reports

The Delhi High Court has refused to order the convening of a special session of the Delhi Legislative Assembly to discuss 14 reports from the Comptroller and Auditor General (CAG), as sought by BJP MLAs ahead of the upcoming Assembly elections.
A bench led by Justice Sachin Datta, while hearing the plea filed by BJP leader Vijender Gupta and other party MLAs, highlighted the considerable delay by the Delhi government in tabling the CAG reports. The Court underscored that presenting these reports in the Assembly is a constitutional obligation and emphasized the need for timely adherence to such responsibilities.
The BJP MLAs had petitioned for the tabling of CAG reports related to key policy initiatives of the Delhi government, arguing that they were crucial for ensuring transparency and accountability.
Senior Advocate Sudhir Nandrajog, representing the Assembly Speaker, opposed the plea, questioning the feasibility of such a move with only 20 days left in the current Assembly’s term. He argued that convening a session at this stage would not serve a meaningful purpose, as the procedural requirements could not be completed within the short time frame.
The Court refrained from issuing any directive for a special session but expressed concern over the government’s delay in fulfilling its constitutional duty to table the reports. The case brings into focus the importance of timely legislative oversight and the challenges posed by procedural delays.
